AESTENTIC TERMS & CONDITIONS


1. Disclaimers
Aestentic provides creative branding, photography, content production, and strategic services. While we strive to deliver high-quality results aligned with your vision, outcomes may vary based on client participation, market conditions, creative direction, and other external factors. Aestentic does not guarantee specific business, financial, engagement, or growth results from branding or content services.

2. Intellectual Property
Upon full payment, clients receive the usage rights outlined in their agreement.
Unless otherwise stated in writing:
Aestentic retains copyright ownership of original creative works
Clients are granted a non-exclusive license for agreed usage purposes
Raw files remain property of Aestentic
Aestentic reserves the right to use completed work for portfolio, marketing, educational, and promotional purposes.

3. Confidentiality
Aestentic agrees to maintain the confidentiality of proprietary or sensitive client information and will not disclose such information except:
With written client consent
As required by law

4. Limitation of Liability
To the fullest extent permitted under Virginia law:
Aestentic shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from services provided.
Total liability shall not exceed the total amount paid for the specific service in dispute.
Clients agree to release and hold harmless Aestentic from claims arising from:
Venue restrictions
Third-party vendor failures
Technical failures beyond reasonable control
Force majeure events

5. Force Majeure
Aestentic is not liable for failure to perform services due to events beyond reasonable control, including natural disasters, government restrictions, public emergencies, illness, equipment failure, or venue cancellations.

6. Termination
Either party may terminate a service agreement in writing if there is a material breach of contract.
In the event of termination:
Client remains responsible for payment of work completed
Deposits remain subject to the Cancellation & Transfer Policy

7. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Commonwealth of Virginia.
Any disputes shall be resolved in the appropriate courts located in Virginia.
